📜 The law text / key provisions
The Trademark Law (2019 Amendment) provides: (1) First-to-file system: priority given to first applicant; (2) Anti-bad-faith registration: penalizes registering others' well-known trademarks for resale; (3) Damages: statutory damages ceiling raised to RMB 5 million and five times for willful infringement; (4) Protection duration: 10 years renewable; (5) Foreigners: can register trademarks directly in China or via the Madrid System. Warning: pre-emptive trademark registration in China is crucial before entering the Chinese market.
