📜 The law text / key provisions

Key practical points:
• The producer and seller are responsible for the product meeting the declared quality and safety standards.
• Labelling must be truthful and clear: specifications, ingredients, origin, and correct usage instructions.
• Producing or selling fake, adulterated or substandard goods, or putting a false quality mark on them, is prohibited.
• A consumer harmed by a defective product can demand repair, replacement or compensation.
• In some cases, seriously defective products must be recalled from the market.
• Keep quality and inspection documents from your suppliers so you can prove compliance if a dispute arises.

💬 Practical reading

💬 This is a general reading/opinion for orientation — not the official legal text nor legal advice.
The Product Quality Law places clear responsibility on whoever makes or sells, which matters whether you are a manufacturer, importer or reseller. The core idea is that you are responsible not only for what you make but also for what you sell, even if it came from another supplier, so verifying your goods' quality and keeping inspection certificates is a basic protective step. Fake or substandard products can bring compensation claims, penalties and recalls that harm your reputation. Standards are updated, so confirm the requirements for your product category. This is general orientation, not formal legal advice.

🚔 Illustrative example / related case

Illustrative, general educational examples — not real specific facts and not legal advice; for awareness only. For an actual situation, consult a licensed lawyer.
Defective goods from your supplier… and you are liable
The situation: A foreign trader running a small shop in a Chinese city bought a batch of electrical appliances from a local supplier and resold them to customers. Later one unit failed and caused minor harm to a consumer, who filed a complaint seeking compensation from the shop that sold it directly.

Applicable law: Under the Product Quality Law, the seller is responsible for the safety and conformity of what it sells to the consumer, even if the goods originally came from another supplier. The seller may afterward seek recovery from the original supplier, but that does not excuse it from facing the consumer first.

Typical outcome: The shop had to address the consumer's claim through repair, replacement or compensation, then tried to recover its loss from the supplier. Those who had not kept inspection certificates and quality proof found it hard to claim back from the supplier.
🎓 The lesson / takeaway: Lesson: You are responsible to the consumer for everything you sell, even if it came from another supplier. Verify the quality of goods before selling them, and keep inspection certificates, invoices and proof of source from suppliers so you can claim back against them when needed.
