Under the Work Injury Insurance Regulations (2010, revised 2011), foreigners formally employed in China are covered if: (1) social insurance is paid by the employer; (2) proof that the accident occurred while performing work duties. Claim procedures: (a) immediately notify the employer; (b) apply for work injury determination at the local Human Resources and Social Security Bureau within 30 days; (c) undergo medical assessment for disability grade. Compensation includes: full medical treatment expenses, care allowance, disability compensation, death benefit (in case of death). If the employer is not registered for insurance, they are personally liable for all compensation.
