China has not ratified the Hague Convention on Child Abduction (1980), so there is no international procedure for immediate return. If a child is brought to China without the other parent's permission: (1) The other party can file a custody lawsuit in China through the local court; (2) Chinese courts apply the principle of the child's best interests (Civil Code 2021); (3) If the child is Chinese: Chinese law has full jurisdiction. Foreign parent options: (a) diplomacy through the embassy; (b) filing a custody lawsuit in Chinese court with legal representation; (c) negotiating with the Chinese parent on joint custody. Settlement: agreeing on visitation arrangements is legally easier than forced return.
