The situation: A mixed marriage breaks down and a custody dispute arises between two parties of different nationalities.

Applicable law: Article 1084 of the Civil Code: the child's best interest is the primary criterion. The Chinese spouse has a practical advantage in domestic disputes because Chinese courts tend to keep children in the Chinese environment. China has not ratified the Hague Convention on International Child Abduction (1980), making it very difficult to return children abroad even if they were originally allowed to leave. Both parents need the other's consent for the children to travel abroad.
